Liability & Participation Waiver for In-Studio Classes and Activities
You agree to adhere to all posted and dictated rules and regulations regarding safe studio participation, including abiding by any by-laws or provincial regulations that may be in place for dance studios at the time of your attendance. Participants failing to comply (i.e. children not following teacher instruction to dance in their specific area of the room) may be denied entry to future classes, without refund.
Masks must be worn when entering/exiting the studio, in all common areas, and when not dancing, as per current by-law, unless exempt. By-law provides an exemption to mask wearing while participating in physical activity. Students dancing may legally remove masks at their own discretion. Note that should you/your child choose to dance with a mask on, Dreamlight Studio is not responsible for any fainting, injury, or anything else that may occur as a result.
While extra sanitization methods, social distancing, and cleaning procedures are in place, you understand that Dreamlight Studio is a public space and therefore cannot be responsible, financially or otherwise, or held liable if you contract COVID-19 or any illnesses while at the studio.
If you/your child/anyone in your household is unwell, showing symptoms/has been knowingly exposed to COVID-19 and/or has been asked to self-isolate and/or has travelled out of the country within the last 14 days, you agree not to enter the studio, as per current Health Canada guidelines.
Due to distancing/capacity regulations, we have very few waiting areas. We ask that you do not arrive more than 1 minute early for your class. If you arrive early and waiting areas are full, you will have to wait outside the building. Please do not bring non-participants with you inside the studio.
To minimize common surfaces, change room will be closed. Washroom is for student emergency use only. Please wear your dance attire underneath regular clothing as much as possible to avoid need to change. Designated shoe changing areas/places for belongings will be available and each student will be given their own space.
For children: parents are asked to drop children off at the studio front door and not enter the building themselves unless absolutely necessary. If parents have a young child who has difficulty staying alone, they may wait in one of our few designated waiting areas in the lobby however these spaces are first-come-first-served, not guaranteed (they may be removed at any point throughout the season if health concerns require us to do so) and once filled, we will not be able to accommodate additional parents wishing to stay in the building. Refunds cannot be given outside of our usual refund policy for children who refuse to participate due to a parent not being in the building. Viewing window in the hallway will be unavailable during this time. For parents concerned this may be the case, we recommend choosing our month-to-month registration option so you can try it without significant financial obligation OR selecting Hybrid registration (in-studio + access to watch live via Zoom) so you can do the class from home together.
If health and safety restrictions or mandated closures are put in place at any point throughout the year which require, by law, for Dreamlight to temporarily discontinue in-studio classes, all classes will automatically be switched to digital only (either live via Zoom or with prerecorded YouTube videos each week, at the studio's discretion). In such cases, exceptions will not be made to our usual refund policy. If you are concerned about this occurring and would no longer want to participate, we recommend registering with our month-to-month option (or lesson-to-lesson option, for wedding dance couples) so that if this does occur you will not be obligated to continue past that current pay period.
GENERAL LIABILITY WAIVER. STUDIO POLICIES, ACKNOWLEDGEMENT OF RISK:
I understand and agree to the payment terms as per my selected payment method. I understand that once a payment is made, it is non-refundable, even if myself/my child doesn’t attend any classes during that time for any reason. If a payment is two weeks late, including due to a declined credit card or bounced cheque not rectified in time, I will be charged a $10+HST late fee. If I’m more than two weeks late, myself/my child may not be admitted into classes and/or recitals. Dreamlight reserves the right to substitute instructors at any time. A changing of instructors cannot constitute an exception to our usual refund policies. If a class is cancelled due to weather, a digital makeup class will be offered.
For group classes and regular weekly private lessons: I must pay for each month in its entirety, even if myself/my child is unable to attend one or more weeks. Dreamlight doesn’t hold classes on stat. holidays/breaks. I understand the monthly price is the same regardless of how many classes fall in a month (2, 3, 4, or 5; most will have 4), as the monthly price is actually based on the cost of the full dance year divided into equal payments for easier budgeting. Should myself/my child wish to change classes, transfer of prepaid funds is at Dreamlight’s discretion, is not guaranteed, is based on availability/time of dance season and is subject to a $20+HST transfer fee. Dreamlight may cancel group classes due to low enrollment & if this occurs, I will be notified & refunded for any paid outstanding classes.
For occasional private lessons and room rentals/participants: I understand that fee is due upon booking and once it is made, it is non-refundable/non-transferrable to another date/time for any reason.
I understand that for Dreamlight to provide regular, quality classes at an affordable rate, Dreamlight cannot make exceptions to the above payment policies. I agree to these payment terms and conditions.
I understand that I should be aware of my/my child’s physical limitations and agree not to exceed them, and to inform the instructors of them as appropriate for safety. I understand & agree that when participating in dance, fitness, acting or theatre, there is a possibility of physical injury or death. On behalf of myself/my child, I voluntarily agree to assume all risks & responsibility for any such injury or accident which might occur to me/my child during any Dreamlight Studio classes, rehearsals, performances, or activities. I also exempt, release & indemnify Dreamlight Studio, its owners, agents, volunteers, assistants, employees, guest artists, faculty members, contractors, instructors, parents and/or students from any & all liability claims, demands, or causes of action whatsoever from any damage, loss, injury or death to me, my children, or property which may arise out of or in connection with participation in any classes or activities conducted at Dreamlight Studio. I further hereby voluntarily agree to waive my rights & those of my heirs & assigns to hold Dreamlight Studio, or anyone connected to the studio as mentioned above, liable for such damage, loss, injury, or death.
I understand that due to the nature of activity instruction, some physical contact/touch between the instructor & students may be required at the instructor’s discretion (to correct posture, arm positions, etc.). If I do not wish for the instructor to make any physical contact with myself/my child, I understand it my responsibility to inform the instructor of this prior to beginning lessons. (NOTE: During COVID restrictions, no such contact will be made regardless and such instruction will only be given verbally.)
I understand if behavioural problems occur that are disruptive to the learning environment/safety of students or instructors, myself/my child may not be allowed to participate in class & such behaviour will not result in an exception to the refund policies. Class ages are guidelines. Students may enroll with a different age group upon request, pending studio approval. While Dreamlight strives to keep food allergens out of the studio area, Dreamlight cannot guarantee or assume liability if students come into contact with their allergen, as Dreamlight is a public space.
I understand Dreamlight always strives to start & end classes exactly on time, but there may be instances where classes begin or end a few minutes late due to class turnovers. I understand it is my responsibility to exit the studio/pick up my child promptly upon class end & that Dreamlight cannot guarantee monitored child pickup or space for me to stay inside while waiting for a ride, bus, etc. I grant permission to Dreamlight to use photos or videos of classes/my child for archive or publicity purposes including, but not limited to, website promos, recital videos, social media & print ads, without compensation.
If I am signing this waiver for a minor, I certify that I am the parent/guardian & have the right to waive these rights.
